Condominium product is the reason this project is on our list at all. Samui's market is overwhelmingly villas, which for a foreign buyer means registered leasehold, and a freehold condominium inside the 49 per cent foreign quota is a materially cleaner thing to own. That is our standing position on this coast and it applies here.
One caution, stated plainly. The project is described as intending to partner with a hotel management company, unnamed, offering a fixed-return programme. A guaranteed return is normally funded out of the purchase price: it is a price concession arriving in instalments. Establish the rate, the term, what happens when it ends, and what the building actually achieves in low season, before treating it as income.

Can a foreigner own ANAVA Samui freehold?
A condominium unit, yes, within the 49 per cent foreign quota of the building's sellable area, which is the standard position under Thailand's Condominium Act and does not vary by province. The purchase funds must be remitted into Thailand from abroad in foreign currency and evidenced correctly at the time, or the ownership cannot be registered. On an off-plan project also establish what share of the quota is still unallocated, because it is finite and can be committed before you reach transfer.
What should I know about the fixed-return programme?
That a guaranteed return is normally funded out of the purchase price. The project is described as intending to partner with a hotel management company, so far unnamed, offering a fixed return. Before valuing that, establish the rate, whether it is calculated on the gross or net price, the term in years, what the arrangement reverts to when it ends, and what the building actually achieves by way of occupancy in low season rather than blended across the year. A guarantee that ends in year five leaves you holding whatever the building really produces in year six.
Why a condominium rather than a Samui villa?
Because of what you can own. Samui's market is dominated by villas, and villas sit on land, which foreign buyers ordinarily cannot own in Thailand, so that product normally comes as a registered lease. A freehold condominium held in your own name inside the foreign quota is a materially cleaner asset with a wider resale audience. That is our standing position across the coast, and it is why the condominium projects here matter as much to us as the villa estates.
