Can a foreigner buy freehold at Kiara Reserve Residences?

On anything still unsold, no. Kiara Reserve's 49 per cent foreign freehold quota is full, so a foreign buyer takes a registered lease, and the villas stand on land a foreigner cannot hold outright in any case. The one freehold route is a penthouse resale, bought inside that quota while it was open.

Two separate limits are at work, and they are often confused. The first is the Condominium Act: foreigners may hold freehold title to no more than 49 per cent of the sellable area of a registered condominium building. That is a cap on the building, not on the buyer, and once it is allocated it is gone. At Kiara Reserve it has been allocated.

The second is land. A foreign national cannot own Thai land outright, and a villa is house-and-land product, so the freehold a brochure describes for a villa is not something a foreign buyer can take whatever the quota says.

A Thai buyer is under neither limit and can own here outright. This is why the honest answer to “is Kiara Reserve freehold or leasehold” is that it depends on the passport, not on the home.

The exception is worth stating plainly because it is the only one. One of the three penthouses is offered for resale by its owner, who bought it inside the foreign freehold quota while places remained. A resale of an existing foreign freehold title can pass to another foreign buyer, so that single home is the only freehold route on the estate for a foreign national today.

The developer's own material reads more broadly than this. The brochure calls the estate 46 freehold residences and the website offers the villas freehold or leasehold and the condominiums freehold or foreign freehold. Ask for the condominium registration and the current quota position in writing before anything is reserved, and take the documents to independent Thai counsel.
